General terms and conditions



ŠUS EUROFITNESS SPORTS CENTRE RULES
Ljubljana, 1 September 2022

The Sports Centre Rules are equivalent to the Terms of Use and constitute a legally binding agreement between the end user (natural or legal person, hereinafter: Client) and the company ŠUS Evrofitnes d.o.o. that manages ŠUS Eurofitness (hereinafter: Centre). In addition to the applicable legislation, the relationship between the Client and the Centre is also governed by all the rules of the ŠUS Eurofitness Sports Centre, all other provisions and the price list.

GENERAL RULES
1. The Centre membership takes effect upon completing the application form or signing a membership contract and upon the payment of membership fee and the relevant training pass fee. When applying for membership, the Client shall identify himself/herself with proof of identity and a photograph of the Client shall be taken. Inspection of a personal identity document shall suffice. Upon entering the Sports Centre, it is mandatory to use a personal bracelet owned by the Client.
The Clients may choose among the following training passes with varying time limits as regards the use of services provided:
ALL-DAY PASS: unlimited access during opening hours;
MORNING PASS: access until 13.00 every day;
PASS FOR SENIORS AND STUDENTS: access until 16.30 every day.
With regard to the relevant pass, only the time of entry is limited, while the duration of training is not limited. All of the above contracts for training passes can be concluded for one month or one year. The Centre facilities may also be accessed outside the time limit for individual training passes, however, the additional entry fee is charged according to the applicable price list.

  1. The Centre membership applies to one person and is non-transferable to another person. All members shall follow the rules that govern membership of the Sports Centre. Sports Centre personnel has the right to request from the Client to present proof of identity upon entry.
    Upon signing the membership contract, the Member is aware of the fact that the personal data (name and surname, date of birth, address, telephone number and e-mail address) collected to conclude the contract is required to fulfil the obligations and provisions contained in the ŠUS Eurofitness General Rules.
  2. The Centre is open from Monday to Friday, 6.00-22.00, and from Saturday to Sunday, 9.00-21.00. The sports facilities of the Centre (fitness, gyms, Spa centre) shall be emptied at least 10 minutes before the closing time, whereas the changing rooms shall be emptied not more than 10 minutes after the closing time. During holidays, the Centre is either closed or open according to the opening hours announced in advance. The Centre reserves the right to alter the opening hours.
  3. Children younger than 14 years of age are not allowed to train on their own in the Centre. The Client shall agree on the training of a child younger than 14 years of age beforehand with the Sports Centre personnel.
  4. Non-swimmers and children younger than 14 years of age are allowed entry to the Spa centre only at specific times, i.e. during a swimming course, Kids swimming playground and individual training classes with Centre’s swimming coaches. 
  5. The entry to the Sports Centre is allowed only to:
    – Clients who are members and who paid their membership fee and their chosen training fee
    – Clients who paid for a daily pass or a single visit
    – Children who attend kids programmes and their accompanying persons
    – Organised groups that have agreed with the Centre to attend certain activities and are represented by a person of legal age
  6. All members shall follow the rules that are in force in the Sports Centre. The members are required to not disrupt the training of other members and to treat all the equipment of the Centre, other clients and employees with respect. If a member of the Sports Centre fails to follow the rules, intentionally causes damage to the facilities, physically or verbally harms other clients or employees, this could constitute the reason for revoking or terminating his/her membership of the Sports Centre at the discretion of the responsible person. The termination of membership with expulsion shall be imposed by the person responsible – Director of the Sports Centre, who also specifies the reason for expulsion.
  7. All users shall behave responsibly towards other members.
  8. All users shall follow the instructions of the Sports Centre employees and adhere to all the notifications, rules and regulations published at the ŠUS Eurofitness Sports Centre.
  9. Entry to the sports facilities (gyms and Spa centre) is allowed only in sports equipment (clean sports shoes, sports swimsuit and slippers to be used in the Spa centre are mandatory) and the Clients are required to use a towel during all types of training. After they have finished with their training or using training aids, the Clients are required to put away, wipe and disinfect the training aids. Before entering the Spa centre, it is mandatory to take a shower.
  10. The responsible employee of the Centre has the right to alter the timetable of activities according to the availability of personnel and equipment and the conditions for work. The responsible employee has the right to alter the prices of training passes.
  11. In the Sports Centre, it is not allowed to take photos, record videos or disturb other members in any other way without prior approval of the responsible person.
  12. It is prohibited to smoke, drink alcohol or consume illegal drugs in the Sports Centre.
  13. The Clients are allowed to bring food and drinks in glass packaging only to the area for socializing next to the reception area. It is prohibited to bring food and glass packaging to the changing rooms and sports facilities.
  14. Animals are not allowed entry to the Centre.
  15. All users are advised to consult a doctor or a qualified person before they undertake training that requires great effort. Extreme strain, overexertion or incorrect exercise may adversely affect your health. The Centre shall bear no responsibility for any injury arising from failure to obey the rules or from incorrect exercise. The Clients undertake training on their own responsibility. If the Client has health issues that prevent him/her to engage in the activities of the Centre, he/she shall inform the Centre about his/her health issues (it is obligatory to submit the results of a medical examination) as soon as they stop using the services of the Centre. In such cases, the Centre can suspend the payment of training pass fee and not debit the Client’s account. The minimum time period for which such suspension may be applied is 7 days. Suspension of the pass fee approved by the responsible person is credited towards the future payment of the pass fee. It is also possible to suspend the pass fee in advance for the maximum time period of 1 month per year due to the absence that is notified to the Centre at least 15 days before the start of absence by sending mail to the address ŠUS Evrofitness d.o.o., Vodnikova cesta 155, 1000 Ljubljana, or by e-mail sent to sus@eurofitness.com. The suspension of pass fee is charged according to the applicable price list.

ADMINISTRATIVE RULES
1. The Centre membership takes effect upon signing a membership contract and upon the payment of membership fee and the chosen training pass fee. Upon signing the application form, the Member is aware of the fact that the personal data (name and surname, date of birth, address, telephone number and e-mail address) collected to conclude the contract is required to fulfil the obligations and provisions contained in the ŠUS Eurofitness General Rules.

  1. The membership fee and the training pass fee shall be paid before entering the sports facilities and before the commencement of training classes. To enter the Sports Centre, the Client shall wear a bracelet that is in his/her ownership, therefore he/she buys the bracelet upon becoming a member. This also applies to Clients with yearly passes for organised groups.
  2. By paying the membership fee and training pass fee, the Client becomes a member of ŠUS Eurofitness Sports Centre for an indefinite period of time and may attend all the activities of the Centre according to the relevant training pass. By becoming a member, the Client undertakes to pay either a monthly or yearly training pass. The training pass becomes valid on the day of concluding the membership contract and expires after one month or one year. A new training pass is automatically activated after the expiry of prior training pass, after one month or one year, and the Client pays the due fee upon his/her next visit to the Centre or via direct debit with Client’s bank or other form of payment offered by the Centre.
  3. If the Client does not wish to extend the training pass in the Sports Centre for the next payment period, he/she shall fill out the form for resigning from membership or notify the Centre about his/her decision by registered post or e-mail no later than 15 working days before the expiry of his/her current valid training pass. If the Client does not pay the training pass within 20 working days after the expiry of his/her previous training pass or does not notify the Centre about justified reasons for his/her absence, the Client’s membership of the Centre is automatically terminated. If the Client wishes to use Centre’s services again, he/she shall again sign a membership contract and pay the training fee, and only then the entry to the Centre shall be allowed to the Client. Any alterations as to the type of training pass shall also be notified to the Centre no later than 15 working days before the expiry of the previous training pass. Once the next payment period starts (when the Centre’s system generates a new invoice for the next time period), it is no longer possible to alter the type of training pass and any alterations shall be taken into account in the next payment period.
  4. The membership contract that is concluded for an indefinite period of time and that allows the Client to terminate the contract no later than 15 days before the expiry of a monthly or yearly time period allows the Client to pay the monthly pass via direct bank debit or other payment system offered by the Centre. The contract may be terminated until the 15th day of the month for the next month by sending a written notification via registered mail or e-mail. If the Client does not notify the Centre about the resignation from membership, the Centre shall extend the training pass into the next payment period or calendar year. It is not possible to alter the type of training pass of Clients with a concluded yearly contract, or, as an exception, any possible alterations may be approved by the responsible person no later than 15 days before the expiry of the previous training pass.
  5. Training pass for organised groups is a type of pass that may be used by companies or organised groups of 5 persons or more. The training pass for organised groups allows an unlimited use of Centre’s services for 5 persons or more. The details of the pass are agreed on in advance on the basis of the agreement with a responsible person.
  6. If the Client resigns from the membership of the Sports Centre, he/she shall not be reimbursed the membership fee, the training pass fee or the fee for the bracelet that is used to enter the Centre and to lock the lockers.
  7. Members shall notify the Centre of any changes to their personal data.
  8. Every rule adopted by the Centre will be published and all the members are required to follow it.

RIGHTS OF MEMBERS
1. The Clients have the right to use the services offered by the Sports Centre during its opening hours.
2. The Clients have the right to write their complaints, opinions and suggestions in the Comments and Complaints Book at the Centre’s reception deck or in an e-mail sent to sus@eurofitness.com.
3. The Clients have the right to request the consultation, rectification, restriction of processing, erasure or transfer of their personal data or raise an objection regarding their data by notifying the Centre in writing in a mail sent to the address ŠUS Evrofitness d.o.o., Vodnikova cesta 155, 1000 Ljubljana, or in an e-mail sent to sus@eurofitness.com.

FITNESS GYM RULES
1. It is mandatory to use sports attire for training in the fitness gym. The Centre’s personnel shall pay special attention to clean sports shoes which the Client shall use only for training in clean facilities.
2. It is mandatory to use a towel during training in the fitness gym.
3. The Clients must handle the fitness equipment with due care. After using the fitness equipment, the Clients are required to put it back in its place and to wipe it if they sweat during exercise. This is especially important in the case of cardio machines during the use of which the Clients often sweat. It is strictly prohibited to use training aids that are not a part of the services provided by the Centre, that leave marks or cause damage to or malfunction of Centre’s equipment or facilities.
4. The Clients are advised to share training aids during exercise in the fitness gym and to agree on their use between themselves.
5. The use of cardio machines is limited to 30 minutes if there are other Clients waiting in line.
6. It is strictly prohibited to take training aids out of the fitness gym.
7. During exercise, the Clients shall respect the rules of the Sports Centre and the instructions of Centre’s personnel.
8. Children younger than 14 years of age are not allowed to enter the fitness gym by themselves.
9. It is not allowed to bring drinks in glass bottles or food to the fitness gym.
10. It is not allowed to enter the fitness gym with a sports bag.
11. The Clients are advised to warm up thoroughly before the start of fitness training.
12. The Clients are advised against using mobile phones in the fitness gym. If the Clients must necessarily use their mobile phones, they shall do so privately and without causing any disturbance to other Clients.
13. In case of any accidents or injuries, the Clients should notify the Centre’s personnel as soon as possible and follow their instructions.

MULTI-PURPOSE GYM RULES
1. It is mandatory to use sports attire for training in the multi-purpose gym. The Centre’s personnel shall pay special attention to clean sports shoes which the Client shall use only for training in clean facilities.
2. It is mandatory to use a towel during training in the gym.
3. The Clients must handle the equipment with due care. After using the equipment, the Clients are required to put it back in its place and to wipe it if they sweat during exercise.
4. It is strictly prohibited to take training aids out of the gym.
5. The gym is intended to be used during programmes for group training and sports games.
6. Children younger than 14 years of age are not allowed to enter the gym by themselves.
7. Due to a higher likelihood of injury, the Clients are advised against joining group trainings more than 10 minutes after they start.
8. It is not allowed to bring drinks in glass bottles or food to the gym.
9. It is not allowed to enter the gym with a sports bag.
10. The Clients are advised against using mobile phones in the gym. If the Clients must necessarily use their mobile phones, they shall do so privately and without causing any disturbance to other Clients.
11. Before joining a group training, the Clients should make sure that the difficulty and intensity level of individual programmes is suited to their physical fitness.
12. The Clients are advised against leaving the training class before it ends.
13. In case of any accidents or injuries, the Clients should notify the Centre’s personnel as soon as possible and follow their instructions.

CHANGING ROOMS RULES
1. The lockers are intended to be used during training. When the Client leaves the Sports Centre, the lockers must be empty and unlocked.
2. The Clients are advised to leave their personal belongings in the lockers during training and to check whether the locker is locked before leaving for training.
3. For locking the lockers, the Clients shall use the bracelets which they receive upon the payment of membership and which remain in their ownership. The Clients are advised to carry their bracelet at all times during their visit at the Centre.
4. The Clients should act responsibly towards the environment and pay attention to how much water they use. The Clients should make sure to discard waste in the dedicated waste bins. The Clients are asked to separate waste.
5. It is not allowed to shave or depilate in the changing rooms.
6. It is not allowed to bring drinks in glass bottles or food to the changing rooms.
7. The Clients are advised to use slippers or sandals to walk around the changing rooms, under showers and in the Spa centre.
8. The Clients are advised against bringing valuable belongings to the Sports Centre; if they bring such items, they can leave them in a safety-deposit box at the Centre’s reception desk.
9. The Clients are asked to dry after showering in the bathroom area and to not wet the area in front of lockers.
10. The Centre’s personnel are not responsible for any theft or loss of items in the lockers or changing rooms.

SPA CENTRE RULES
1. Before entering the Spa centre, it is mandatory to take a shower and disinfect feet. If the Clients do not take a shower before entering the pool, this could constitute a reason for the expulsion from the Sports Centre because such behaviour can lead to poorer quality of bathing water and failure to comply with hygiene standards.
2. The swimming pool is intended to be used by swimmers; non-swimmers are not allowed to enter the pool except during specific, organised activities.
3. It is not allowed to bring food or drinks in the Spa centre area.
4. It is mandatory to use swimming attire (sports swimsuit) and slippers or sandals.
5. The Clients are not allowed to bring their own swimming aids, unless they agree on their use beforehand with the pool attendant.
6. It is prohibited to jump in the pool or swim under water.
7. The Clients shall respect the limits regarding the number of persons in the pool, sauna and jacuzzi.
8. The Clients shall follow pool rules, markings in the pool area and the instructions of the pool attendant.

PERSONAL DATA PROTECTION RULES
ŠUS Eurofitness commits to closely protect personal data of its Clients and to use these data in accordance with the legislation for personal data protection (Regulation (EU) 2016/679 and the applicable rules in Slovenia), ŠUS Eurofitness Personal Data Protection Rules and internal rules of the company.
ŠUS Eurofitness Sports Centre, i.e. the Controller and Processor of personal data, respects the privacy of its Clients and ensures that their data shall be used exclusively for the stated purposes and to the extent strictly necessary or for specific purposes based on the prior consent of Clients.
The Data Protection Officer of ŠUS Eurofitness, i.e. the Controller and Processor of personal data, is the company’s Director Gregor Pečovnik.
ŠUS Eurofitness collects the following personal data of individuals – members of the Sports Centre:
Name and surname, date of birth, address, e-mail and telephone number of members; in the case of a child, also the name and surname of a parent or legal guardian, e-mail and telephone number of a parent or legal guardian.
ŠUS Eurofitness collects and processes personal data of Sports Centre members for the purposes of company’s operation, as defined in the basic or other acts of ŠUS Eurofitness and when such personal data processing is in the interest of the Sports Centre and its members.
The company shall collect and process personal data for other purposes of collecting and processing data on the basis of consent for:
a) keeping the records of long-term injuries or illnesses that prevent a member to attend training for more than 7 days which provides the basis for the suspension of a training pass, whereby an individual member shall inform the representatives of ŠUS Eurofitness about an illness or injury;
b) informing the Clients about special offers and events and the promotion of ŠUS Eurofitness via e-mail or telephone (on the basis of consent).
In the case of a child, the collection and processing of child’s personal data for other purposes are only carried out on the basis of a consent signed by one of the parents or a legal guardian.
If an individual does not consent to collecting and processing personal data for other purposes (one, several or all other purposes) stated in the consent form, this does not in any way affect the exercising or fulfilling the obligations of membership and performing the activities.
ŠUS Eurofitness shall not transfer personal data to a third party, except in cases or for purposes defined in these Rules and in the consent form.
The Centre shall keep Clients’ data until termination of membership.
The rights of Clients as individuals in the case of granted consent are laid down in the applicable legislation. The Clients may revoke their consent at any time, request the consultation, rectification, restriction of processing, erasure or transfer of their personal data or raise an objection regarding their data by notifying the Centre in writing in a mail sent to the address ŠUS Evrofitness d.o.o., Vodnikova cesta 155, 1000 Ljubljana, or in an e-mail sent to sus@eurofitness.com.
ŠUS Eurofitness guarantees to carry out all the technical and organisational protection measures to ensure the protection of personal data.
In the case of a breach of personal data protection, ŠUS Eurofitness shall immediately carry out all the internal and external measures (technical and organisational) to protect the rights and interests of an individual, shall inform every involved party about the breach and shall also inform the competent supervisory authority in the Republic of Slovenia.
An individual may also file a complaint regarding issues about personal data protection with a competent supervisory authority, i.e. the Information Commissioner of the Republic of Slovenia.
ŠUS Eurofitness Personal Data Protection Rules shall be amended as required and ŠUS Eurofitness Sports Centre shall ensure a timely and relevant notification of members regarding any amendments to these Rules.
Personal Data Protection Rules are a part of ŠUS Eurofitness General Rules and are published on Centre’s website and available at the Sports Centre reception desk.
